Terms and Conditions of Sale (Used Equipment)
1. Scope of Agreement
These Terms and Conditions apply to the sale of used equipment by Techquip Ltd (the "Seller") to the buyer (the "Buyer"). All equipment is sold strictly on an "as-is" basis and is intended for business customers only.
2. Condition of Equipment
All equipment is sold "as-is", without warranties or guarantees, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
3. Deposit and Payment Terms
To secure an order, a non-refundable deposit of 10–20% of the total sale price is required. The remaining balance must be paid in full prior to delivery or collection. Accepted payment methods include bank transfer or other methods as agreed in writing by Techquip Ltd.
4. Collection and Delivery
Unless otherwise agreed, the Buyer is responsible for arranging collection of the equipment from the Seller’s premises. Shipping terms used are Ex Works (ExW) or Delivered at Place (DAP) in accordance with Incoterms 2020. Ownership and risk pass to the Buyer upon full payment.
5. Non-Refundable and Final Sale
All sales are final. No returns, exchanges, or refunds will be accepted after payment is completed. Techquip Ltd may, at its discretion, provide after-sales support or assist with repairs on a case-by-case basis, but this shall not constitute an obligation or warranty.
6. Taxes and Duties
The Buyer is solely responsible for any and all taxes, duties, customs charges, VAT, or other fees arising from the sale, including those associated with export and import into the destination country. Techquip Ltd assumes no responsibility for compliance with destination country regulations.
7. Limitation of Liability
The Buyer assumes all risks upon payment and collection. The Seller shall not be liable for any damages, direct or indirect, or claims arising after the point of transfer of ownership.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the English courts.
9. Entire Agreement
These Terms and Conditions represent the entire agreement between Techquip Ltd and the Buyer. No amendment shall be valid unless made in writing and agreed by both parties.
